Terms of Service

Yuimaru is a private platform intended for leaders and employees of independent IT service provider (ITSP) companies. These ToS apply to any user with an account, regardless of role.

By creating an account and using the platform, the user accepts these ToS, the Trust Charter and the legal notice without reservation.

Registration is reserved for legal or natural persons acting in a professional capacity. Each membership request is subject to manual validation by a Yuimaru administrator.

• The user undertakes to provide accurate, complete and up-to-date information about their company and profile.
• Account access is personal and secured by password. The user is responsible for keeping their credentials confidential.
• Nankuru reserves the right to refuse, suspend or delete an account that does not meet the circle's criteria or these ToS.

Yuimaru enables members to list their company, exchange opportunities, request technical mutual aid, send connection requests and communicate via company-to-company messaging.

• Comply with the Trust Charter, in particular the non-compete and client-ownership protection rules.
• Not use the platform for canvassing, spam, harassment or distribution of unlawful content.
• Not attempt to access other members' data by indirect means.

Each member is solely responsible for the content they publish, the opportunities they share, the exchanges they conduct and the partnerships they enter into with other members.

Nankuru implements reasonable measures to ensure the availability, security and proper functioning of the platform. Its liability may only be engaged in the event of a breach of this obligation of means.

Nankuru does not intervene in commercial relationships between members and cannot be held liable for disputes, breaches or damages resulting from exchanges carried out via Yuimaru.

Elements of the Yuimaru platform (brand, software, design, text, databases) are the exclusive property of Nankuru or its licensors. Any reproduction or exploitation without authorization is prohibited.

Content published by users (company profiles, opportunities, messages, attachments) remains their property. By publishing it on Yuimaru, the user grants Nankuru a limited license necessary for hosting and displaying it to authorized members.

Data collected is processed by Nankuru as data controller, in compliance with the General Data Protection Regulation (GDPR).

This agreement is entered into for an indefinite term from acceptance of the ToS.

• The user may suspend their visibility or delete their account at any time from their settings.
• Nankuru may terminate or suspend access in the event of a breach of these ToS, the Trust Charter or any activity likely to harm the circle.
• Upon termination, the user's data is retained only for as long as strictly necessary to settle legal and contractual obligations, and is then deleted.

Nankuru may modify these ToS at any time. Users are informed via a message on the platform or by email. Changes take effect thirty (30) days after notification.

Continued use of Yuimaru after that date constitutes acceptance of the new ToS.

These ToS are governed by French law. In the event of a dispute, the parties will seek an amicable solution. Failing that, the competent courts shall be those of the jurisdiction of Nankuru's registered office.
